A Guardianship Order allows someone to make ongoing decisions on behalf of an adult with incapacity, like paying bills, dealing with bank accounts, making decisions about care and personal welfare matters. Adults with incapacity lack the ability to make decision concerning their own finances or welfare. If a Power of Attorney is already in place you do not need to apply to the Court for a guardianship order.
These must be granted by the Sheriff Court in Scotland. We deal with applications for guardianship orders and intervention orders and minutes for renewal and/or variation of guardianship orders and for appointment of additional guardians under the Adults with Incapacity (Scotland) Act 2000.
Your application to be appointed Guardian must be supported by two statutory medical reports. We will arrange for these on your behalf. Legal Aid may be available so please enquire with us and we can advise.
